California requires BOTH: Daily overtime (over 8 hrs/day) AND weekly overtime (over 40 hrs/week).

Example: 10-hour shift → hours 9-10 should be 1.5× rate

Example: 50-hour week → hours 41-50 should be 1.5× rate

5. Meal Breaks (30-minute unpaid)

"Uninterrupted" means:

  • ✓ No work duties during break
  • ✓ Not "on call" for customers
  • ✓ Free to leave your work area

Required for shifts 5+ hours

Common violations (these are NOT legal breaks):

  • ✗ "You can eat while you work"
  • ✗ "Stay nearby in case we need you"
  • ✗ Break was only 15-20 minutes

6. Rest Breaks (10-minute PAID)

Required Rest Breaks by Shift Length:

  • • 3.5-6 hour shift = 1 rest break
  • • 6-10 hour shift = 2 rest breaks
  • • 10-14 hour shift = 3 rest breaks

Must be in the MIDDLE of work period (not at start/end). Cannot be combined with meal break.

Penalty: 1 HOUR of pay for EACH missed rest break (even though break is only 10 minutes). This is one of the most valuable penalties.
